Each state has its laws and they're not all the same. Even within states sometimes different courts have ruled in opposite directions in those situations where there is some interpretations to be made.

Each agency has its own practices and they're not all the same.

If adopting internationally, then U.S. federal law becomes an issue, and all he countries of origin are different and have their own laws.

Birth moms are all different and they will have their own preferences and absolutes.

Usually with a question like yours, there's a question behind the question. For a more useful answer, ask that question.
