Looking for information on adoptive step parents
I was wondering if anyone had information on the laws concerning the legal adoption of a new spouse's children in the case that the other biological parent doesn't agree?

To the best of my knowledge, the only way to terminate a biological parent's rights in favor of a step parent's adoption of the child is if the biological parent has endagered the child in the past in a proveable way (ie: has been convicted of those charges), or if the biological parent has abandoned the child in a proveable way (ie: failed to make child support payments, refused to visit during many scheduled opportunities).
If either of those are the case, a lawyer well used to family and adoption law has a good chance of winning the case in court. Specific laws vary by state regarding what offenses are actually harmful enough to the child, or the length that contact or support of the child has to be avoided before the parents' rights are terminated. |
