I'm on th Kansas ADN board and the president currantly lives in Illinois, so I've been working with a lot of people there as well as in Kansas. I also have relatives there and am in the process of doing a private adoption from a disrupted Illinois international adoption. I can see where you might have been confused.

Some cases require licenses in Illinois....
I live in Illinois. I really believe that in order to adopt through an agency in Illinois, we had to have a foster license. I can tell you that if we were to adopt an out of state child or baby.......we definately had to have a license. However, if we adopted privately through an attorney--we would NOT have to have a license.
This makes NO sense to me either, and as long as individuals have to have fingerprints, background checks, etc....as long as the individual isn't adopting an older or waiting child (who have issues)...then I see no reason for the license. But, that's Illinois for you. And, I agree with the poster that this nation needs to have more uniform adoption laws. The only problem is that some adoption laws are so poor....those wouldn't be the ones I'd pattern after!!!!! But, it's like the Interstate Compact agreements. I do not understand why----if the adoption is done legally in one state----the couple should have to wait for their home state to 'agree' to take the child in their state! Makes no sense to me!!!! Colorado
For children in the custody of Social Services in Colorado any child under the age of 5 must be placed in a foster/adoptive home. Then the clock starts ticking within a year that child must be either returned to the Bio parents or be adopted. This law was created to keep kids in a home that could become permanent, and to keep the kids from being bounced from placement to placement. MOST of these situtations are considered a "legal risk" some however are riskier than others.
We have adopted one almost two kids through this process. Our first two kids were legally free and did not require foster care by us. But had been abused in their foster homes. Go figure! Private adoptions are not prone to this law. Fostercare licensing is not required for private adoptions. P.S. Glad to see your back Linny! ![]() |

Each state so different...
Just like each state being so different in their requirements regarding having a foster care license, so are the differences in the type of adoption. Research is the key to both of these issues. Find out what type of adoption you are interested in (international, independent, fost/adopt) and the requirements from the agency/lawyer/facilitator. Adoption is a very complex process - one that takes months. You will receive a stack of paperwork to fill out along with a "to do" list required from your adoption coordinator. The best thing to do is check them off one by one with the realization that it won't happen overnight. A pregnancy takes nine months, why should an adoption be any quicker? Don't expect that...if it happens, count your blessings! The hard part of the "waiting stage" is that you usually don't have a "due date" for awhile, or if at all. A birthmother adoption is the exception, of course, because she will have an "expected date of arrival," but, other adoptions (international and fost/adopt) don't have this luxery. I can say that our wait was exactly nine months!! Amazing. Hang in there everyone! Find out the requirements necessary (in your state and the type of adoption) and check them off one by one!
