Angry Athens, Ga wanting step parent adoption

Anyone know how i can get the non-custodial parent to sign his rights over. He hardly see's the kids and never pays child support. When i told him to sign his rights over so he woudlnt have to pay child support he said no. Any ideas? My husband has been with our kids since they were 18 months old. He would really like to adopt the kids. Any suggestions?

Your first mistake in all of this was telling him that he wouldn't have to pay support any more. That decision isn't up to you - it's up to the judge and he may or may not forgive arrearages.

What you've done is cast a shadow of 'coercion' on your process...

I suggest you view the laws in your state regarding abandonment and see if your case qualifies...if not, then having him terminate is really the only option.

OK. The first thing that you need to do is to go over to the child support recovery office at the corner of Hawthorne and Oglethorpe. It is in the shopping center where the jewelry store is going out of business. Go north on Hawthorne through the light towards the YMCA. The strip mall is on your right. The child support recovery office is at the far left. Take the time and fill out the paperwork. They will then take up your case, free of charge. They will file the appropriate paperwork with the state. This will accomplish a couple of things. It will garnish his wages, including the back child support that you are owed, at a reasonable rate. It will also suspend his driver's license for failure to pay child support. He will be notified by mail of the suspension. He does not have to be "served". From then on, if he drives, he is driving on a suspended license and will be arrested if he is stopped by the police. He will have to work it out with the state to get it back. I am sure paying child support in full or in part is part of the reinstatement process.

I am not sure that there is a way to force a biological parent to sign a TPR. I don't think you can. If he is crazy or physically dangerous to your children, that is one thing. If there is nothing, you may have nothing. You can always call Legal Aid on Washington street and ask them. Keep in mind though, if you tell them too much, they cannot represent you in court in his case.

Two options:

Go after him for child support through your local child support recovery office. This will make it "uncomfortable" and maybe he will see the "not paying child support" as a better option.

Or you can file an abandonment charge. This is the route we are currently taking.

I don't know if your ex will have to pay the child support arrearages but I was told by my lawyer that once we have his rights terminated that he will not have to pay child support anymore. The $50 a week isn't worth it anyway.
