I am in Florida, and my ex-husband is in jail and has not been in touch with my son for over 4 years. After he went to jail we did have a fight for grandparent rights with his mother...she won visits with him but never showed up. My problem is I know once I start this process I will have a fight. Since the grandmother has a right to visit him is it still valid after the adoption? I would also like to know what is the easiest, and least cost effective way to do this. My new husband and I are very happy and also have a daughter...we are a family since he has been around since my son was 2 and is now 9 years old.

I believe if you called the local courthouse in your area that they will assist you. I live in FL and the bgrandparents would no longer have any rights to visit. Since the BF is in jail they can serve him a "consent and waiver by parent "that he can sign and have noterized and sent back to you. My husband adopted my daughter and I will assist you if you would like help. I also have a web site that you can go to and print out the forms ness. to do the adoption.
