I have a seven year old daughter and her dad and I have been divorced since before she was 1 year old. My current husband and I have been married for 5 1/2 years and she has always called him daddy. She very rarely sees her bilogical father but does have regular visitation with his parents and we get along with them really well. Her bio dad sees her maybe once every two or three months when she is at her grandparents. She wants her last name to be the same as ours. We also have two sons together. My husband wants to adopt her very bad. Her bio dad does not pay any child support but was not ordered to (long story). He never calls her and very rarely sees her. What could we do for my husband to adopt her? I would still let her go to her grandparents. I'm just not sure what all the laws are and I don't think her bio dad would give consent just out of meanness. Any advice would be greatly appreciated.

I have a 2 years old daughter. The Bio father has had nothing to do with her, and he doesn't pay child support. What is the time frame for abandenment?
I recently got married in August and my new husband wants to adopt her, she loves him and calls him Daddy. I would like to know what kind of right if any that the biological father has?
