Crossing State Lines for step-parent adoption

The man I will marry soon wants to adopt my son. The father came to the hospital on the birth day and saw his son the one time. His name is not on the cert. because he never showed-up for the signing of it and we were'nt married. I have never persued child support and never will. I have tried to contact him to let him know how his son is, but the last time was when he was 3 mo. old. The bio-father is in a TX jail and has not seen his son since his birth one year ago. The father has never had a "legal" job with a "real pay-check. Do we have to go through all the legal matters regarding adoption?
