Crossing State Lines for step-parent adoption

His name is not on the cert. because he never showed-up for the signing of it and we were'nt married. I have never persued child support and never will. I have tried to contact him to let him know how his son is, but the last time was when he was 3 mo. old. The bio-father is in a TX jail and has not seen his son since his birth one year ago. The father has never had a "legal" job with a "real pay-check. Do we have to go through all the legal matters regarding adoption?
