Length requirement for new marriage?

I plan to remarry in spring '02 and my new husband wants to adopt my son, who will be 2 years old in March. My ex-husband (my son's father) has stated he will consent. Do you know if it is legally required or even common practice for the court to prohibit such an adoption until my new husband and I have been married a specified period of time (i.e. one year)? I have been researching Indiana code and can find nothing on this. Also, Indiana code states that when the child is over 2 yrs. old the court can order postadoption visitation priveleges to the biological father. (He does currently visit.) Does anyone know if this is ever done over the objection of the custodial/adoptive parents? Thanks for any help!

Please tell me what Indiana code explains the postadoptive visitation by the bio parent. I have consented to the adoption of my son by his step-father on the condition that I will still have visitation but I wasn't aware the it could be court ordered.

We contacted an attorney, but he told us that a judge wouldn't even her the case until we have been married at least a year ( to show stable home enviorment). It's very unfair in our opinion, but good luck. The post adoption visitation thing is only if the court decides that it would be "detremental to the childs well being to not have the bio in his/her life"
