Question Mediation & Self Step Parent Adoption

My husband and I have filed for him to adopt my now 12 yr old daughter. Her bio-father has a pattern of abandonment, 2 years away & 6 months or so back, then away for another few years. This time we figured it was time for us to take action and stop letting him run over this family like this.

We have filed our petition, and tracked down bio-father (in prison in CO), and he has contested the adoption. My question now is do we NEED mediation? I would hate to file the motion if I don't have to, but I don't want to slow things down. I really want to get the hearing underway, and let the judge see this guy for what he is.

Any help is appreciated. Thanks!
