Hi. I've only lookied into things a little here and it seems that you have to have a lawyer. I called the clerk of courtsin Linclon county and they told me you can't file your own paperwork. that's as far as I have gotten. Good luck.

Hi,
Thanks for replying. I too am the birth Mother and am looking to faciliate the adoption of my daughter to my husband/step-father. The Bio Father has been out of the picture since I was three months pregnant and isn't on the birth certificate and my husband is wanting to adopt. I have yet to consult a lawyer. I've just surfed around for some general info. If you have any thoughts or info that would be greatly appreciated. I'm in Sioux Falls and even lawyer recomendations are helpful. I agree we are a rare breed out here on the web! (hopefully not so many typos in this post!) THANKS! |

Well, I haven't been here in a while, but I am MelsMomma (my old id doesn't work for some reason).
I am recently married and would like for DH to adopt my DD. Her BF isn't going to give up his rights very easily (he doesn't care, it is just that it will make him "look bad"...). I am in Brookings, Painter71. I too am trying to decide WHICH lawyer to contact. I know we will need one. Can we in SD "use" (bad word) child support as an incentive of sorts for relinquisment? I don't think you can, it is coersion... but I am hearing of others saying how their exs signed their rights away because they pointed out the fact that they wouldn't pay support then. MY ex doesn't pay support and never has (in 5 years) and also hasn't supported our daughter physically or emotionally he entire 10 years of life. My DH has supported her like his own since we started dating over 4 years ago and I guess in my opinion (and those of a lot of others who have known us ~yes even my ex's family) it is only right that he be able to adopt her and make it "legal". Yes, we have her full time, etc... but think of it like a marriage... You can live together forever but it isn't "legal" until you are married. I guess that is an ok metaphor. Anyways, if and when anyone else wanders to this section of this site, any advice is greatly appreciated! |

Hey, I work for an attorney......email me and I can see what I can find out for you..... My son was adopted by my husband after we got married and it didnt take much......the sad part is the b-father signed papers within 20 min. of my first notification to him but it was for the best!!!!
