My husband and I desperately need either a copy of someone elses' petition from oregon or advice on where to get a cheap one of our own we have looked everywhere and tryed several from other states and have not once found any form acceptable for the oregon courts we are beyound frustrated and no one can tell us much of anything the lawyers on top of which want 1,500. to start for an uncontested petition (the bio moms rights are terminated by the court) and thats without them even representing us, please any advice will be seriously appreciated

We have found a place where we have been able to purchase do-it-yourself legal forms. http://www.legaldocumentcenter.net/ You have the option of having them fill them out for you and getting them all typed up nice, for a fee. Much cheaper than a lawyer. We used them for my husband's divorce from his ex. (she had moved to another state to be with another man before I had even met DH) We paid the fee to have them do the paperwork, very easy. They asked questions, filled in the answers, what wasn't understood was explained. After it was all typed up, they told him where to file it, how much it cost, how long to wait, and what to expect next. We are going to use them again when we do our step-adoption. Best of luck!!

Just thought I would warn any others trying to file petitions for step parent adoptions in Umatilla County Oregon by law the way I was told if the non custodial birthparents rights are terminated then not only do you not require their consent for the adoption but they have no more legal say than a stranger well if you get a judge who has a personal bias/ preference one gender over the other be prepared for a fight in our case I am trying to adopt my husbands bio kids (ours in every way that matters) not only is the bio mothers parental rights terminated due to severe documented abuse etc but even prior to termination she had no real contact and when she would the kids were always hurt not withstanding the fact I have also been the only mom the kids have really know for well over 2 yrs anyways as I was saying even with every thing in perfect legal order a thing as simple as a judges bias can make it difficult to impossible.let me point out so no confusion arises also the termination I know to be valid besides the fact a judge signed the order, child support accepted it as valid to discontinue her support obligation based on the fact her parental right were terminated.

I am so sorry to hear that the judge is making this difficult for you. I hope he pulls his head out of the sand and just signs the order. Sometimes there are idiots (judges & other people in genrel) who STILL feel badly for the non-custodial birth mom just for the very fact that she gave birth to a child or children. Never mind she is the one who walked out on her kids, treated them like crap, allowed them to expericence horriable things most of us in our right minds would never subject any child to, got HERSELF in to trouble with the law, repeatedly! Maybe that is just the deadbeat Birthmother who gave me my third child. Hang in there! Goodluck!

Hi and thank you for the response and encouragement it is def frustrating when legally he has no grounds to say we have to have her consent but he is anyways even if we wanted to ask her we have absolutely no ideal where she is all we know is the last state she lived in quite a while ago so the 2 wks he gave us to contact her would do us no good anyways but the judge already knows this and said it doesnt matter I agree that just because you are a birthmother doesnt give you the right to do what ever you want and still keep the kids the judge knows alot about whats happened including the fact that the birthmother particapated in sexually molesting our then 4 yr old daughter with her girlfriend and yet he is still seemingly convinced that birthmothers come first even before the children anyways I have already told him if he trys to force a consent or denys our petition even though he knows the law says he cant since her rights are terminated I will get a lawyer so maybe that will be the wake up he needs although I doubt it since their still insisting we need the consent of a parent who rights are fully terminated and have been for a year. Anyways it sounds like your son is lucky you came into his life and I hope everything works out for you also. I am sorry for going on so long it just really makes me mad when judges think they can rewrite the laws how they wanna read them.

Just an update, frustrated rant, and hope for some advice, Ok well the judge did throw out the termination apparently her rights are not terminated but her obligation to pay child support is, so she can have the priviledges with no responiblity? Well thats a great call to make irresponible people! Anyhow he isnt giving in, I was almost ready to give in but knowing the sick and serious threat she is to the children I cannot allow myself to do that we do not have the money unforunately at this time to follow through with the threat of a lawyer (the judges are really bad about jerking you around if you dont have one here) and I seriously dont know what else to do, the termination and step parent adoption thus far has taken alot of money and since he is getting ready to throw it out unless we find her for the consent or come up with the money to redo the stupid termination (which really gets me by the way how could the judge who signed the legal order for her termination now look at the same paper and say her rights are not terminated?????eek: then we are in a tough spot it would be so much easier if I didnt feel like I had to do this asap for the kids safety anyhow anyone have any advice, suggestions anything if you do please respond any info would be great!
