Step Parent Adoption

You are correct. I just recently went through this process and the Ohio Revised Code states that if a father has had no contact with the child or not paid any support you do not need his permission for the adoption. It used to be that both of these events had to occur before you could proceed with the adoption, however, the law has changed and now only one of the above events have to occur. "GOOD LUCK"

We have filed and have a court date, but I did have to notify him. Even though he has not seen or contacted, nor paid support, for well over a year, he still has the right to be notified. As he is going to be selffish, he plans on protesting. I have been told he does not have much of a leg to stand on, but if we did not allow him to fight it, he could have come years from now and argued that the adoption took place without his knowledge, and if he can prove it, the adoption would not be held up. So, be careful how you apporach this. I did not want to have to deal with him, but if I do it now, when he hasnt been there for the past four years (except sporadically), I do not have to deal with him at all in the future. The biggest downfall, aside from having to see him again and put my daughter through all of this, is that if he knows about it and wants to contest it (with or without a leg to stand on) the price went up dramatically, which did happen. Thats my experience...
