I have a 12 year old son that my husband of 11 years wants to adopt. We wanted to wait until "our" son was old enough to make his own deceisions on wether or not he wanted my husband to adopt him or not, and when he came to us 3 years ago asking question, we sat down with him and explained everything to him with no harsh fillings about his bio. father. We asked him if he wanted to be adopted by my husband and he said yes. We are now financaley set to proceed with the adoption. I guess my question is, can we go about this adoption without the consent of the bio. father which has never had any contact with him since birth or do we need his signiture? His name is on the birth certificate. And can i still collect back child support or will that ruin the chances of abandoment charges?

Are you in Canada or the States?
Filing for adoption on the grounds of abandonment in Canada does veto back pay of child support. I think the laws would vary from State to State in the US, I suggest you phone your local family court and see what they say |

I live in Pennsylvania. Sorry, i forgot to add that. Thanks for the bit of info. I will have to call the family courts here.
