Step-mother adoption
My ex-husband has had custody of our son since the divorce some eleven years ago. My ex-husband is due to be married within a matter of weeks and his bride-to-be wants to adopt my son. My son will be 12 in a couple of months and has told me that he wants his soon to be step-mom to adopt him. My ex-husband and his fiance have promised to still allow me to see my son whenever my son wants to see me. I have a few questions: Can I be forced to sign these adoption papers since I do pay child support, though I haven't been allowed access to my son in over a year and a half? If I voluntarily sign the papers, when are my right rescinded? Will it be effective the day the papers are filed? Or will it be effective the day the adoption is finalized? Can I file a paper with child support requesting that my child support obligation be terminated after I sign the adoption papers? My ex-husband is considering 'forgiving' the entire child support arrearages that I owe, is that legal? Can he really make child support forgive the arrearages I have or will I still have to pay them? I have so many questions, but cannot afford an attorney. Please, someone help me and give me some advice. Thanks!
