question about NJ law and adoption consultants

Hi there..i am in NJ and am aware that NJ residents can NOT work with adoption facilitators. I am considering using an adoption consultant. Is this legal?

Not really! Consultant is just a fancy name for facilitator and while you probably won't go to jail over it it's really not "kosher" in states where facilitators are illegal.

hi stormster.thanks for your reply..that is kind of what I thought about it being a fancy word for facilitator.

I should contact an adoption attorney in NJ. Any recommendations out there for that?

I just have to interject....I don't think that the terms 'consultant' and 'facilitator' can used interchangeably. Well, they may be, but it is erroneous in my experience. We are working with both....the major difference is that the facilitator advertises and deals directly with bmoms. The consultant works with agencies and attorneys.

Facilitators are not allowed to be used in different states. However, as an example, facilitators are not allowed to work FROM Pennsylvania, where I am. But we can use them in other states where the adoption can be finalized there. We would have to enlist the help of an agency and attorney, or just an attorney, to finalize.

As for consultants, I don't know if that's illegal anywhere....they're really just matchmakers with attorneys or agencies. We were recently matched using our consultant. Our match was with one of the agencies they work with (our consultant works with over 30 agencies and attorneys....we were often being sent situations to see if we wanted to be submitted). We then have to go through the process of becoming a client of the agency. The nice thing is that the consultant stays with us throughout the process working as our advocate.

Our consultant was told by the state to stop way before we used her which we found out about when we submitted our expenses for finalization And we saw the order

Sorry no and she did not help us with finding our sons birthmothet but it was still annoying that we paid for a service she should not have been providing!
