Okay, this may get complicated...

My brother-in-law's ex-wife is having a baby. She is in jail and recovering from heroin. My exSIL's family called my BIL to see if they would adopt the baby (BIL and exSIL have a son together who is 14) because he and his current wife are having infirtility issues and are considering adoption. They feel like their lives are already too immeshed with exSIL and said they couldn't do it, but called us because our adoption four years ago was a "heroin baby" (hate that term). They would like to keep the baby in the family as he is the sibling of their son.

So that's the overly complicated backstory. Now we were not looking for another adoption, but we are very seriously thinking that we could do this. Does anyone know if this would be considered a kinship adoption? Last time we went through the state as fost/adopt so we are essentially newbies as far as private/kinship goes. If this happens we would like it to be as uncomplicated as possible and if we could do it as a kinship that would be great. (Am I wrong that kinship is much easier than all the others?)

Our CW told us that if the bioparent claims you as family you can do kinship. We are in a very small county and I think they just dont want to have to deal with little ones if they dont have to, so it may be different where you are. I would just call and ask, the worst they can do is say no.
