Update: Lead Testing for Used Clothing

Secondhand Stores Escape Lead Law - Money News Story - WYFF Greenville

A federal ruling means that thrift stores and consignment shops will not be forced to test children's products for lead.

It was announced on Friday that the new law that requires lead testing will not apply to the secondhand market.

Officials said it would have been a nightmare to test every toy drum and every other donated children's product for lead.

While estimates vary, critics of the new lead law said testing could cost as much as hundreds of dollars per item, affecting their ability to re-sell used products.

But late last week, thrift and consignment stores learned they will not be required to test.

"It's a really big relief," said Crystal Hardesty, of Goodwill in Greenville. "It was a big concern for us because it really was going to affect our business and what we're able to do in the community. So we're really happy to have these regulations clarified and what our responsibilities are clarified."

However, people who make children's toys or clothing -- even if it's a small operation in their basement -- will be required to prove to the government that their products do not contain lead before they can sell them

The law goes into effect in February.

I'm glad THAT'S cleared up.....however, to me, the law still has problems.

We don't make toys/clothing or anything like this; however, everyone knows small groups who make 'one of a kind' types of toys, etc won't be able to continue. That's too bad. If any of us thought Wal-mart was too large and the aspect of 'mom and pop stores with cute items to sell' went to the wayside.....this law will surely kill any remaining groups.

FWIW.....ever check out the Christmas lights and assessories so many of us buy/use? If you'll read closely, you'll see that MANY of those products contain lead and suggest 'washing your hands after handling because of the lead residue'. If this is news to you...I understand. Two years ago, I took some treelights back to the store because of this. To the manager and my surprise, ALL of the Christmas lights/items had this type of warning on them! Hmmmmmmmmmmmmmmmm.......

Too bad. I can appreciate the cautions; but I believe it steps over the line by making it illegal in forcing small companies doing hand-made crafts, to 'test'.

Linny~I learned about the Christmas lights and lead a few years ago. I was shocked,but more shocked nobody has done anything about it.
