An ATIN will work with Turbo Tax and you can still e-file.
The only way you will not be able to e-file is if you do not have an ATIN or a SSN or because you did not have a successful DOMESTIC adoption and you paid fees in 2007 or years prior to that. With a domestic adoption ONLY you can claim the fees you paid in the tax years before the tax year you are filing (so this is 2008 tax year meaning any fees in years 2007 or earlier can be claimed). You have list your agency or attorney you paid fees to at the bottom of the form 8839. We successfully did this in 2003 after a failed adoption in which we paid fees in 2002. International Adoption is a whole other kettle of fish and I think you have to have a SSN to get the credit, meaning you have finalized the adoption.

We did our homestudy, paid 25% of our placement fee and for 2 post-placement visits, and made two trips out of state to the agency in 2007 in the process of getting approved - and then we got domestic newborn placement in July 2008, but haven't finalized yet.
So we can efile with TurboTax with her ATIN, and go ahead and claim what we spent in 2007 for now, correct? I would *SO* happy-dance if that's the case!!!
