Adopting in PA; Live in NJ... have a question.

We are adopting from PA, and our baby is due in two weeks. We were wondering if anyone has experience in PA, and how long they had to stay there while the inter-state compact paperwork was completed?

Our lawyer told us to plan on two weeks. Seems long, was hoping someone could weigh in.

You really need to check again with your lawyer. In PA the termination of parental rights do not happen for 30 days. Those consents for the TPR can only be signed 72 hours after birth, so in essence it is 33 days.

I would imagine that you can not leave the state without TPR, and since it is as long as it is in PA, then you will be here for more than two weeks.

However, I could be totally wrong about this, someone correct me if I am........

The emom can sign after 72 hours but she has 30 days to revoke. I'm sure you can go home after the TPR has been signed but just remember that emom has 30 days to revoke. We live in PA and wouldn't adopt here because of the 30 days.

Was smoking crack the whole time during pregnancy, was stealing from stores, trying to hook out of my sisters house...wouldn't keep her blood sugar under control, etc. so we had to give her a choice...go to drug rehab or go home! She decided to go home because she wasn't ready to get off of the drugs! She was planning on taking us for everything we had (her words) if it were to be a boy!(we would of found out on 5/28) My heart is still breaking!

We adopted in another state and TPR was after 72 hours but couldn't go home till the interstate paperwork was signed by both states. We were there almost 2 full weeks.

California is the same as Pennsylvania in that the birthparents also have 30 days after signing TPR that they can change their mind. However, once TPR's are signed and ICPC clearance goes through, you can leave the state. The birthparents just have 30 days after TPR that they can change their mind. Our agency has had placements from both states, and the adoptive parents were permitted to leave after ICPC, they just had 30 days until the birthparents could not change their mind and take the child back.
