Finalization Frustration

Today I once again called the law office to find out if the petition to finalize my son's adoption has been filed yet. And guess what? The termination of the birthfather's rights was never done BACK IN OCTOBER. So now the sheriff can't locate him to serve the papers and the judge had to appoint a curator who has to spend a month or so trying to locate him. Then they will have to file a motion to terminate his parental rights. My son will be 9 months old next Monday and it seems we will never finalize! I am SOOOOOOOOOOO angry right now!

5/29/08 - Matched!! Due 7/08
6/3/08 - Baby F born. Surprise!
6/7/08 - Adoption plan fell through
7/11/08 - Matched! 20 month old girl and 3 month old boy
7/12/08 - The kids are in our care! Instant Family (just add water)!
3/20/09 - Finalized! We are legally, and in all other ways, a family.

Girl, I have been where you are. We spent 18 months looking for bdad with private investigators and it was my husband's secretary who found him via the Internet! 18 months!!!!! I feel your pain and the key is to let your attorney feel your pain. I became a THORN in her side. We called almost on a daily basis. I found that when I cried, hysterically I might add, she seemed to pump it up a notch. I was never ugly, you don't want them working against you, just pour your heart out and make them want to help you. Sometimes I went on a rant, geez, at $250 an hour I felt like she could hear my thoughts on the justice system and the abuse I thought adoptive parents had to endure, I just didn't make it personal to her. Please no flames on the abuse bparents feel, I am not one so I can only comment on the abuse I felt as an aparent. Best of luck to you.

I am soooo sorry you are dealing with this. How did this happen? I would really push them to explain why this wasn't done sooner. It's outrageous.

OMG, I'd be livid... How in the world did this happen?? Was this an agency adoption or private attorney? I only ask b/c our agency was responsible for terminating BF rights; but then our attorney checked to make sure it was done. I am so sorry!!

I am so sorry! Our twins were 1 before our adoption was finalized and older than that by the time we got their birth certificate. They had a hard time locating the legal father although the birthfather had already signed 2 days after they were born. In our state, if the birthmother is married but he isn't the birthfather, the husband still has to sign. He was in Iraq and the military took a while. It is a pain! I'm sorry you are having to deal with it.
