I posted in relative adoption, but I had to post it here too for you all to see....
TPR occurred today! (yeah)! Bio-mom did not show up, she told her lawyer she did not have a ride and that she could not ride bus because she was "scared" of them! (yeah the DA's office said "thats a new one bus-a-phobia")! Bio-dad got on stand told real reason, she is 3 months pregnant. Bio-dad was a SHOCK to see there, since he has dont NOTHING to work his plan. Well after a LITERALLY 9-5 trip to court rights were terminated on BOTH parents. Of course they get to appeal, which lawyer tells me they have 30 days. Bio-dad said that if the judge does not put on the paperwork that they filed because of (DNE) which is suppose to be something like they put her in danger and left her in places that were dangerous, they he will NOT appeal, but if judge files like that he is appealing. I dont know what bio-mom will do, knowing that CPS is going to take her other child away, may hinder her. Well, bio-dad has NEVER called to check on baby, never seen her, never worked plan, never bought her a thing, so today he calls right when we leave courthous wanting to know what she needed. I almost screamed, I told him that she did not need anything. He said that he was goingto buy her some diapers, I just told him whatever. He said that he would bring them by the house I told him that was NOT allowed still and he could NOT see her. At the end of conversation he said "Ill call later to talk to *****", and ive been advised by my attorney to tell either parent to talk to CPS until appeal process is over with, so they dont try and use things against us. I just hope that they will NOT appeal, I cannot do this another 2-3 years. If they dont appeal adoptoin will take about 6-8 months they say! (ive waited a long painful year, we can do it)! We continue to pray for the best for our lil Princess. Im so happy to be the chlid of such a GREAT GOD. And be a member of a forum with GREAT people who have been so supportaive. Congrats! I hope there is no appeal so you can complete an adoption quickly. As for dad wanting to know what the baby needs, too little-too late. Doing stuff AFTER TPR can't help an appeal. He can only win an appeal if there were errors made in the case. That rarely happens.

Another thing that rarely happens is bio actually hiring a lawyer and going through the whole appeal process. My niece filed an appeal; but when she learned they wouldn't let her use a court-appointed lawyer, they never heard from her again.
My attorney went ahead with our petition to adopt, filing it on the very day the TPR was done. Attorney said, "Maybe there's a tiny chance that she will pursue the appeal but there's no chance she will win. We can deal with that when and if it happens." The court waived several waiting periods and our adoption was finalized five months after the TPR.
