Sending or Receiving State?
Our son was born in Texas but we reside in Oklahoma - our agency (who is in Texas but has an office in OK) insists that we must have 5 post placement visits per Texas law in order to finalize in Oklahoma. I spoke with our attorney today and she said that we only needed 1 post placement visit (which we had today - yay) before finalization... she said you aren't required to follow the sending states rules unless you are going to finalize there - she said she would clear it up but our agency is adamant that we must complete all 5 visits... argh,
I know that when we adopted our older son (who was born in IL) we only had to follow Oklahoma rules (though IL at the time were identical) - anyways just looking for any feedback - lol. thanks gina

Our daughters were born in Texas, we lived in California, and we finalized in Texas. We worked between two agencies one in California and the other in Texas. We did have the 5 social worker visits, two in person and three over the phone. The social worker came from our agency in California. We sent paperwork monthly for 6 months into the agency in Texas telling about their physical development, and medical updates (our doctor filled these out). However... I don't know whose laws these were abiding by...
Personally... I just did what they asked and let the system process the paperwork. |

We are in Texas and only have to have two. One was May which was one month after placement and the other will be September one month prior to finalization.

yeah Texas changed their rules late May, the changes which include homestudies now only being valid for 6 months (our in OK is good for one year but in order to clear ICPC we had to have it redone as it was older than 6 months), and the new 5 post placement visits, and a few other things too ! For instance we had to provide them a floorplan of our house which designated what each rooms use was, we had to provide the names, ages, occupations and location for both our parents, and all our siblings.
Trying to remember what else, but a bunch of stuff changed in late May... I know there is proposed legislation that would require adoptive parents to meet the requirements of both the sending & receiving states but I don't think it's passed - which would mean for instance that in OK you can sign the TPR at 72 hours and it is irrevocable but in California you can sign at 72 hours but its revocable for 30 days (without the waiver), if we adopted from California we would have to wait the 30 days even though the adoption is being finalized in Oklahoma. Anyways I was just curious if anyone else had dealt with having to deal with this... thanks gina

DD was born out of state, we're in California, our attorney is in California and we finalized here per California's laws. Her birth state's laws were pretty much irrelevant to us. I say, listen to your attorney. Maybe have her/him talk to your agency on your behalf.

We live in NC, adopted from Ohio, and are finalizing in NC. Ohio requires 7 post-placement visits, NC only requires 2. We are only required to have the 2 per NC law in order to finalize here.

Yuna was born in Texas and we live in Kansas. We were required to do five, which was frankly a major pain. I don't know what Kansas requires as we were never given the option.

I would say do what...
the agency asks and if you are concerned, talk with your attorney. We are still waiting for our finalization at this point due to our judge who has insisted that we met the adoption laws in both the sending and receiving states. I am told by our attorney that this is not legislation yet but we must do what is required of the judge. Good luck on your postplacement visits...
