Native adoption

I adopted my little boy at birth whom is 5 now. I was wondering is there anyway the bfather can try and take him back. He was stripped of his rights and the adoption has been final since 2003.

Hi Anina:

My husband and I were looking into native adoption and our case worker who works with the adoption attorney told us that because of the Indian Child Welfare Act we would have to verify that we were affiliated and registered with a tribe in order to proceed with a native adoption. My husband's family supposedly has Algonquin and Chickasaw blood but has never tried to register with these tribes and there may be no way to prove his affiliation/ties. We only have pictures which might help.

You would need to discuss this matter with your attorney. Supposedly the tribe the child is affiliated with has jurisdiction over custody cases (?) Don't quote me here. However, I think if the BF has signed away his parental rights then there is not a case. I am sure everything will work out. Don't worry. Just discuss this with your attorney. All the best,

I have very very little knowledge on this - but doesn't the tribe have to give permission for the adoption prior to it being finalized?

If you have any questions I would defintiely have an adoption attorney, familiar with the native regulations review everything.
