Putative Father Waiver of Interest/TPR Question
For those that have adopted domestically (or will) - how and when were the putative father's rights terminated?

My situation wasn't straight adoption-I fostered/adopted mine and the birth father's rights were terminated when he was arrested for violating parole. Even though he can't go near the kids (there are 5), DSS wanted a TPR from him.

Stephen's bfather went to court with bmom and they terminated rights together in front of the judge.

I think every state is different, since they do not all have the putative father registry. In Ohio the putative father has 30 days to register before his rights will be terminated. When we went to court there had to be a document from the state saying that there had been no father sign the registry and from there his rights were terminated.

In TN he can sign prior to the birth, and the pbdad in our match has agreed to sign, although he doesn't currently have an ID so we're waiting on that. If he ends up not getting an ID, the lawyer told me we'd have to terminate in Texas (where we live) and I'm not sure yet how that will work.

In our case, bmom would not name the bdad in order for the agency to serve him papers, so we had to wait our state's required 30 days after babe's birth (we have a putative father registry in Indiana). At that time, he was TPRd.

Ours had to have an add run to terminate his rights, and it had to run for 4 consecutive weeks in the local paper of the last known county of the father. If that info is not given then it will be run in the county of the bmother and her name will be posted along with the date of birth of the baby. We had our child in our home for 3 months before this was done. Thank God nothing came out of that three month wait. I hope this helps with whatever you were looking for.

In our state
The potential birthfather (we're still in process) has no legal standing if he has not supported the mother, lived with her or shown any emotional/financial support to her. He gets served with a subpoena and they take out an ad in the paper. He really doesn't have a leg to stand on, even though he hasn't signed away his rights.

We are in TN, our daughter's birthfather is in Washington state and signed before our daughter was born.

We had to run an ad in a circulated paper in the area of his last known residence. It only had to run for two consecutive days for two consecutive weekends. We did that but he ended up coming back to out state just a week or so before the TPR hearing. Fortunately he signed, we had all of our paper work in and they turned it into an adoption hearing and finalized it that day as well.

In the state DD was born, we had to advertise in the newspaper of record in the county of the last known residence for 4 weeks and then wait an additional 30 days for the putative father to present himself in court. When he didn't, the judge did the TPR.

DS's bfather signed over his rights prior to DS being born (but it didn't take effect until 72 hours after DS was born). Our lawyer is extra-cautious and always files with the putatove registry, which is suppoed to be 30 days, but it took a little while longer to verify with the state that no one came forward (not sure why)

We had the putative father registry in TX and b-father's rights were terminated after 30 days. We were not concerned due to the circumstances surrounding her conception.

putative father registry
Just curious.........has anyone had a bdad come forward after his rights have been terminated using the registry? We met the bdad, he knew about the adoption plan, but never showed to have his rights terminated. (He and bmom live together, but never married.) Obviously his girlfriend came home from the hospital with no baby........he never showed to visit her in the hospital......but I still wonder why he didn't sign and we had to terminate using the registry. I'm hoping it was just the less painful way to deal with the situation for him?? I'm the one who was waiting for ICPC for almost 6 weeks, so he had plenty of time to come forward after the birth...........I just wish he had signed

My daughter's father came forward after TPR and appealed it. The case drug on for 15 months, but his appeal was denied.
