Contempt of court possible after adoption?
Do you know if they will still file contempt of court charges on past due child support even after the step parent adoption goes through for the amount they owe, the bio owes over 16,000 , but I am not sure if they will even push enforcing the past amount she owes if the we do the adoption?

Past due Child support cannot be forgiven or discharged in bankruptcy (my ex tried to claim this when he filed years ago). It is due and payable until all is paid or the custodial parent agrees to close the case. I was in the situation many years ago and we decided not to have hubby adopt because my sons father started to show some interest again. My son is now almost 20 and his father owes $18K, even after I lowered the amount of support due and waived interest (10% here in Cali). He has a wage attachment and I also receive his IRS checks every year. He has offered to pay it off this week, but wants to pay less. I was going to say $15K since he said $13K, but he started with threats again and 100 phone calls to the point the police, phone company and the courts (I am filing a restraing order on Monday) are involved. Silly since he owes the money.
I also wanted to say that there was an error in his case and he was allowed to adopt his step-son during the time he was not paying me. He was in Utah, so they had no idea he was not paying for his first. He went on to have one more kid and so I agreed to take less support for my son, so his kids could have more. I found out 2 years later that his wife was pg again when I agreed to take less.I never would have done that if I would have known. I think you need to take care of the ones you have first and then if you can afford it, then have more. The other side to this crazy story is that my son had two open heart surgeries at 10 and 15 months and still needs one more in the next year or so and will need additional ones every 10 years or so. My hubby and I covered the dental and medical for him, so my ex would not have to pay out of pocket for him. Saving him $300 more a month. I have been fair, but enough is enough. So no matter what, what happens before the adoption takes place, that is owed and payable money to you and your child. Best of luck!

Thanks for the reply and I am so sorry to hear about all you have been through,
its frustrating because the bio mom has never got in any trouble whatsoever for refusing to pay and shes never payed a dime even though we repeatedly requested they enforce it through contempt, taking away her license etc but they wouldnt and now that they are finally saying they will in a few months but the adoption is going through so I assume as soon as they find out they will refuse to do anything further. |
