Adoption Tax Credit-A question about facilitators
quick question: are facilitator expenses qualified expenses for the federal adoption tax credit? we're busily trying to figure this stuff out and it's the weekend (so facilitator can't contact me). anyone know?

From www.irs.gov:
"For both the credit or the exclusion, qualifying expenses include reasonable and necessary adoption fees, court costs, attorney fees, traveling expenses (including amounts spent for meals and lodging while away from home), and other expenses directly related to and for which the principal purpose is the legal adoption of an eligible child..." |

yep, i read that irs blurb and in typical fashion it doesn't really say anything

Seems like facilitators would fall under the "other expenses...for which the principal purpose is the legal adoption of an eligible child..." The burden of proof will be on you to justify that to the IRS, though, so you'll have to decide if your facilitator did indeed meet that definition. Facilitators are not legal in my state, so I don't have any direct experience. We have claimed the tax credit, though, and haven't gotten any grief from the IRS for any expenses that we listed.

I believe I saw somewhere in some IRS publication that a facilitator is a qualified adoption expense if they are legal in the state in which you resided at the time you used them. My advice, ask your facilitator.

Already asked our facilitator and the answer is yes!
