Unhappy Civil Court

Can biological parents ,petition in Civil
Court a Motion to Modify Kinship Adoption?
Parents, only sign promised, child name asstay same, parents could visit anytime or they would No never sign, after final the parents shown papers the child name changed, visits limited. Child crys, yells, My name is to(birthname) when told by step kinship you arenot (birthname)over over.
Parents want to go to Civil Court, cause itwas like a contract, they sign only on theagreed promises set, No agreements
then there would be No consent, hereby
No adoption, No retain right of Kinship tochange child name or cut visits, It is the child rights,to still have birth name.
Parents didNot waive couseling,there by
they didNot know byLaws of adoption anddidNot have lawyer, kinshipadoption wasonly to child better school, after divorce. Not to force child into emotional horror. Yes parents were promised, and
coerion,tricked,duress,trusted.
Can parents Petition Civil Courts to
Motion to Modify Kinship adoption?

So, your asking if now, years later, the biological parents can petition the courts to vacate the adoption decree based on duress and coercion?

The short answer is yes anyone can file a petition.

The long answer is, yes, if they have unlimited financial resources to take on such a legal battle…but the outcome is likely not to be in their favor.

Open adoption agreements, or in your cases, agreements for ongoing contact within a kinship adoption, are not legally binding in most states…in addition, if this adoption took place more than a few years ago, its likely that no states had open adoption laws on their books.

Is it morally right what your adoptive parents did? No…but legally, if an adoption took place (which I cant really tell based on your post) they are your parents and can make all of the decisions for their minor child.

Ban stick? Isn't that deodorant?

Brandy,
Hold up on the passing of the moral judgment based solely on the nearly unintelligible ramblings of the OP. If this isn't a case of ESL I'd probably run like **** in the other direction too...
