We just had the IRS reject our e-file tax form because someone else (We assume the birth father who gave up parental rights.) has claimed our adopted child with the same SS number. He did this the first year we claimed David as our dependent in the year 2000. Now he is doing it again in 2004. This is is just an annoyance for us, but is there any way of preventing this?

This is why I'm having the kids' ssn's changed.
He has to prove support. Since you have the child, he can not. The only thing I could recommend is finding out if you could get your child a new ssn.

This happened to my sister this year also. She called an IRS agent who was very helpful. They are going to audit both tax returns, of course they will discover that my sister is entitled to claim the child, and her ex will have to pay back the refund plus penalties, interest and possibly jail time. The IRS agent told her the ony way to prevent it from happening is to file your return first. Hope this helps.......but I know how frustrated you must be. My sister could really use the refund, but it is being delayed because of this audit.
