having birthmom approach me

I am always talking about using our agency for our adoption, but what if a birthmom approaches us (locally, in state) to adopt her baby. If we have the homestudy done, what do we need to do?
I am guessing get a lawyer for us and get a lawyer for her, We would request her to get some counceling to be sure she is making the right decision, and of course medical care if she needs it.
But what else. I know each state is different but general info would be great.
Thanks All,
Amanda

What we did.

We adopted our daughter privately. We know the family and the birthmother. We retained a lawyer for ourselves and for her, as separate counseling is required. There are still laws to follow. She must go through mandetory counseling. The lawyers will draw up all of the papers. One suggestion though, discuss with your lawyer getting a permanent order of custody until the relinquisment and final adoption is signed. It may save a lot of hassel down the road. You never know what unforeseen circumstances may arise. You may not be able to obtain a permanent order in your state, only a temporary order, but try for the permanent. Make sure to obtain a lawyer who has expereince in adoptions. There are a lot of laws to follow and red tape to get through, and learning as you go isn't the best thing to do. I don't know if this helped any, but I hope it did. I hope all goes well for you and your family and I will say a prayer for you. Good luck! :-)
