Help with adoption subsidy questions
Five years ago my husband and I adopted our two children from foster care in Arizona. We receive an adoption subsidy from the state of Arizona. Soon after our adoption we moved to South Dakota. We are now in the middle of a nasty divorce. My husband has asked the judge to divide the subsidy according to the amount of time that we each spend with the children. I have argued that the money is not child support and it is for the care and special needs of our children, who were both drug exposed and one had ADHD. The judge refused to rule on the matter until our custody trial next month. Mean while my husband quit his benifited saleried position of eleven years with no notice in order to evade child support. He then asked the judge to lower his child support. To my shock the judge stated that he would not squeeze blood from a turnip and that I would be okay anyway because I get child support from an adoption subsidy. Does anyone have information that I could pass on to my attorney that might be helpful? Has anyone delt with this issue before? Any help at all would be appriciated.
