Does the magistrate look at everything in front of him or does he just decide to give the child back?

my little one has been with me since she was 4.5mths old, now 21mths. birthmom had other daughter taken away and given to the paternal gp. She was given no goal in the case plan until 6mths ago. Magistrate ordered a homestudy done on her and boyfriend. Both failed the homestudy due to boyfriend and her having no safe place to live, no running water and him not having his kids.....they then both went on to fail the psych evaluation. The agency is goign for PC but can the magistrate change his mind. Will he look at the info they have put in front of him. I am scared to thinkhe will give her one more chance regardless. November 20th is the big day, not looking forward to it.

As with anything in foster care, you don't get any guarantees. But I would assume that the cw's input will be be heavily weighed. And, with a failed homestudy, an unfavorable psych eval, and all of the other stuff, the state must have a very strong case or they would not be bringing it to trial--assuming that's what is going to happen here.

The best advice I have is to try to stay in the moment and not look too far ahead.

Doesn't look good for bp's. They have a lot against them and the longer you have fc the more of a case you have for stability and attachment. If there is a way to somehow get 3rd party/intervenor status you should do so since you've had your fc so long.
