a little bit of the background of this story... I had a placement of 3 for almost 8 months they have been sent home in may with mom agreeing that the babys father is not around any of the children and he will get sv with his baby once a week...fast forward 3 months I get a call will I take the baby back and the other two went to a cousion...I say yes there were 5 different counts against mom and dad...baby stays with me for 3 weeks and the there was court children sent home with dad getting a gps on his ankel....well now there is a hearing on mon. because his probation officer is taking the gps off because he keeps going out of bounds with it and setting the alarm off and the po is sick of it well I call the cw and ask how it looks for mon and she says that the kids will probley stay....I can't tell the whole story but these children have been in care for almost 3 years and only been home for 3 months...belive me I am one of those people that want the children back with birth parents but I really am scared that the next time they might not be lucky to get out ok.Mom can't keep the children safe, this last time they have been sent home the oldest one which is only 5 told the judge that she does not want to go home. I don't get to go to court which really stinks... I feel like the cw on this case is not doing her job and she could care less what happens to the children. I am looking for any advise on how I could be heard. Thanks for letting me vent.

Is there a way to communicate with the judge via a form or letter? In CA we have a special form to complete (JV 290) or we can send a letter. Everyone receives a copy but it is a good way to communicate with the judge.

Also, does your state have de facto/3rd party status? In many states after a placement of 6 months you can file for it. Although some states don't have it or you have to have your placement for a year. This will allow you to be in the court and even have representation for yourself. You also will get a copy of all court documents therefore you will really know what's going on.

Lastly, do the children have a GAL or CASA. Speak to them and voice your legitimate concerns. They should be able to speak for the children's wishes and best interests.

Have you met the GAL or CASA person? If so, definitely contact them. I had a GAL for a FC get upset when a birth mom wanted an infant to get ears pierced. Her words were, "I forbid it." Thus, if you get someone who should be representing this baby in court on your side, I would recommend that.

I am sure the other items mamachell mentioned will work. I just don't have any experience there.

Here's a thought. I don't know if it will work but can you express what is best for these children (based on your experience with them) to the CW in writing and cc their Supervisor? I am not suggesting going over anyones head. More of a just making sure everyone is on the same page. If that makes sense.

the problem is that the cw is afraid of dad..she did a surprise visit and knew dad was in the closest she does have a reason to be scared but all she had to do was go to her car and call the police and they would have taken care of it but she did nothing The aunt and I both called the case worker and left her know how we feel about this case she says that we should hire a lawyer we say no if you all were doing your job that we would not have to....we asked about the childrens guardin for court and she said oh well he is for mom and dad..HELLO ok there is the problem he is not standing up for these children!!!! See this a new cw to the case...the old cw was threatened from dad and was taken off the case for her well being which is understanding i really wish that there were more cw like her because she didn't just think of her job just as a job she loved everyone of those children in every case that she had. I feel that this new cw is like what ever happens, happens at the end of the day she gets to go home, I mean I was telling her about tpr laws and mom and dad hit everyone of them any way she say the countys name and says well the such county goes by there law what pa is pa. Thanks for letting me vent. I do I a question if the guardien for the children for court is not doing there job what can I do??? who do I talk to.... The aunt and I were thinking about getting a rally together for Monday... we just do not want to do anything againt the law.
