TPR official today!!!
As of this morning our fs is legally free. TPR was signed and we are the adoptive resource. Now on to the adoptions unit. TPR was by default so there is no appeal process. I am so happy and relieved.

They serve the parents and publish in the paper(parents have been MIA for a year). The parents much show up on the date served or published, if they do not a default judgement is entered. Approx a week later, there is a hearing and if the parents again fail to show, the default judgement is signed and a default judgement is non appealable. I had never heard of a default judgement in a dependency case until I moved to my new state, so this was how it was explained to me and how it actually happened.

I think alot has to do with the state and/or county you are in. I know even voluntary relinquishments and default judgements had an appeal process timeframe for our case.

khollan: I think I was probably misinformed, I googled this last night and found out that although it is not an actual appeal, they do have 30 days to file a motion to set aside the default judgement. I don't think that will happen in this case as no one even knows where the bio parents are and their attorneys did not object, but you never know. I guess if you really want to know anything you have to research it yourself, that's why I love google LOL
