Talked to CW about appeal
Its good news I think. Cw called to answer some of my questions regarding the appeal. She said she had talked with the states attorney and judge last week and that everyone said that the tpr was written very strongly with lots of evidence. Then the cw said that bio dad asked the judge to reconsider his tpr...and judge said NO....saying that there is nothing to reconsider. Even his attorney said so. LOL. States attorney said that the appeal shouldn't take long ...that she has had several go through and come back within a month. So maybe not as long as I have worried about.
My own attorney said that he has no doubt in his mind that the appeal won't overturn anything; that tprs are done only after significant evidence and time and that appellate courts rarely overturn circuit courts. So....SIGH......i'm breathing easier. My 9yr old asks nightly when I tuck her in bed, when will I be able to adopt her. The 11yr old asks each week if there is a visit....and is relieved when I tell her NO. The baby(2yr) knows nothing but me as mommy. Maybe the adoption will take place this year afterall.

FWIW, in my county, there hasn't been a case overturned on appeal in over thirty five years. And let me tell you, lots of them get appealed! Seriously, please, do not spend a minute of energy worrying about this. It's just another bureaucratic hoop you have to jump through, but nothing is going to change. The girls are safe, they are loved, and you will soon be adopting them. :-) All the important things are taken care of. On your adoption day, I'm going to do a little dance on my coffee table for you. :-) |

That is wonderful news Kristin!
We've been told that it is extremely rare for a TPR to be overturned. Sleep easy girl, it sounds like the girls are soon to be yours forever.
