Has anyone ever heard of a Continuum?

My friend who is a foster to adopt has court tomorrow for TPR but the CPS attorney asked for a continuum on the birth mom. So now court is rescheduled for a later date? What does this mean? What is a continuum and why would they have to reschedule?

Oh yea and I think its for a psych evaluation.

i think she is refering to a continuance

the lawyer would need to ask for one of those in order to get a later date in order to have the psych evaluations done or the results back if that is what he needs in order to prove his case during tpr, as oposed to going forward and the judge dismissing based on the fact that the eval was either not done or the results are not back

Would they ask for this because they feel their is not enough for the judge to approve TPR? Why would they decide to do this at the last minute?

My FS TPR hearing is scheduled for tomorrow. The county is asking for another 90 days (!) to search for the BD some more. Someone said he may be in Tijauna because that is where he was deported to...like he is going to STAY there! So, more waiting. I think this is too often common. The state/county want to make sure there is no way the BP can come back later and claim their rights weren't given.

It is not at all unusual for cases to be continued - and for them to be continued more than once. There are many reasons that a case might be continued (technical issue needs to be resolved, attorney schedule, court schedule, expert evaluations are not complete . . . )

As to why is happened at the last minute - my guess is that the state's attorney has a large caseload and while they do keep track of all cases on an ongoing basis, they really don't look at the technical details of any particular case until preparing for trial shortly before it is scheduled.

Continuances are frustrating for all involved, unfortunately they are often unavoidable.
