what happens to the child when bio is facing deportation
Im asking this question for a friend whose three yr old fk mom has just been released from prison and is like facing deportation, prior to jail time mom was working her case plan for reunification< will they also deport the child or does mom loose her child im hoping mom wont loose her child because of something that occured prior the child being born any one know how that woks

If the child is an Americn citizen, then no, the child would not be deported. If the child isn't an American citizen and was taken because of child abuse or neglect, then CPS may choose to keep the child in the US and use the courts to do so.

Not true. While the child wouldn't be 'deported' that doesn't mean he/she won't be sent to the bio's native country. The child is considered a dual national..both of the bios native country and the United States. If RU was the plan its highly likely the child will return w/ the bio.
