Can someone please explain what...

a "legal risk" versus a "non-legal risk" is?

Legal risk means the child's parents have not been TPR'd (termination of parental rights) yet. Non-legal risk means the child's parents have had their rights terminated and they are legally free for adoption.

This is what I had thought it was all along also, but when they called us about K coming back they asked if we were a legal-risk home, I told her I think so and she said are you wanting to adopt and I said yes. So when the lady brought her to our house I asked her was K a legal-risk placement and she told me legal-risk was a way to protect us from having a child removed for the purpose of adoption by another family. I hope I explained that well enough. This was totally different then what I have been led to understand what legal-risk meant.

Legal risk means that tpr has not occured. This a risk situation, they are not legally free for adoption, but there might be a chance that they will be. So their is a chance that the child/children can return to b-parents or if b-family step then the child can be moved to them. My son was a legal risk, it took 3 years to finalize. I had another legal risk that was in my home for 14 months, then returned to the father. Another legal risk that went with grand parents after 4 months in my home. It is a emotional rollarcoaster.

Non legal risk is children already legally free for adoption. So when they come to your home they will not be moved (unless you request it)
