6 month to final question

We were placed with two fs's we have been persuing for over a year. We are waiting for mom's rights to terminate. Will the 6 month to finalize start at termination or has it already begun? CW told dh it would be a minimum of 6 months till we adopt. I am assuming she was referring to the 6 month rule. Anyway, we are so anxious to get closure.

I know here in Florida the child has to be in your home for 6 months before finalization can occur..maybe that is what the CW is talking about?

I think it depends on where you are. June is the tentative TPR court hearing. Our cw told us that after that, we have 90 days wait for relatives to show up, after that they'll start the adoptive process. If everything goes smoothly for us, we will consumate the adoption in December. Because the kids will have been in our home for over a year at that point, the day the judge signs is the day the adoption is consumated. We live in Texas.

Awww... In our case in Dec2007 we were told 6mo... And I found out last week, the TPR hadent even been finalized. She has been in our home for almost 2 years. Grrr... Frustrating... Nothing we can do, but wait... Its hurting the kiddos in the long run, they need to know where they will be.

So does the time they are in our home now count towards the 6 months?

YES!! In all jurisdictions that I know of, if all other factors are taken care of (TPR, appeal, etc) that "6 month" rule starts counting from the minute the child comes into your home. In fact, with ours, we were told we could adopt the same day as the TPR (since it was a voluntary surrender, so no appeal) since he'd already been with us 9 months.
