Now I have to go through all this nonsense proving that I adopted them and that I have been fostering them since April of last year. They have been in my care well over 6 months...
I am so ticked!!They have NO RIGHT whatsoever to claim my children especially my adopted children. Somebody also claimed my foster (soon to be adopted) son whose has been in my care since April of last year and I'm not having it!!!! I have gone through heck and high water with these kids and these (ummm I can't think of any words that I can use on this board that accurately describes them) people have the audacity to claim MY CHILDREN!!!!! And I am now being told that I have to wait another 2-3 months to get the refund I DESPERATELY need NOW!!! MAD doesn't even begin to describe how I feel right now.....

Ugh, I am sorry you are going through this. I am still waiting for my daughter's birth certificate and then getting her a new social security number. The new SS# is because the chances of her SS# being abused by extended bios is large.
I hope it gets cleared up quickly for you.

There are only a few circumstances where you can get the social security number changed.

Having had to deal with the IRS last year on a different matter I can express my sympathy. They are a difficult bunch to work with! My advice is to call the IRS and talk to a person directly (which can take like 2 hours on "hold"). All the back and forth letter writing didn't do anything for us but when I finally got hold of a person they resolved it pretty fast.
good luck and it sure does stink and it is sure wrong. |

I am so sorry you have to go thru this. Personally, I'd push for them to be prosecuted for a false tax return - you can beat & abandon your children in this country but you could go to prison for life for screwing w/ the IRS. I'd make that my next mission.

I am getting new socials for my adopted kids (they are toddlers), but I was going to wait until after taxes. I could just wait to file after I get the new socials, but then bio gma (the one who had my oldest son put in foster care to begin with because she didn't want to raise him) will get away with tax fraud. She gave up her right to that privilege when she decided to have him moved into foster care. Her getting away with defrauding the government by getting money that she doesn't deserve for MY CHILD seems grossly unfair to me!!!
However I cannot change my fosters son's ss# because he is not "legally" mine and the only way I can claim him as a dependent now is if I go through with the investigation, which I have no problem with because I have nothing to hide. His bios on the other hand do.

Stay strong - you are a strong woman!!! This (hopefully) is just the last slap from g-ma-your already on it & getting it taken care of-you WILL see this thru - we all know you've been thru so much this year - this is just another bump in the road.

That is so ridiculous that they would do such a thing, but at the same time not surprising either. I recently found out from *A's* attorney that her bio moms key interest in her is simply for monetary reasons and the financial support she'll get for having her, rather than interest in her as a person. It makes me sick to say the least, so I won't be surprised at all if she tries to claim *A* on her taxes too even though *A* has NEVER been in her care, she went into foster care straight from hospital, but non the less I wouldn't be surprised to learn she tried.
I should think simple county placement papers would be enough proof as they contain the date they went into placement with you and I suppose worse case scenario the CW could write a brief note on County template paper that states the date they went into care with you and that it is affirmed they have been with you in your care since that date. Now I don't know if the IRS will accept a fax of that info or need it mailed, but I don't think proving it should be any more difficult than that.

When Pumpkin's adoption was finalized, I had a new SS# issued to her rather than keep her old one...just in case stuff like this happened.

You should be able to apply for a new social for the child/chidlren under the "domestic violence victims" bulletin published in Oct 2006.
It's here New Numbers For Domestic Violence Victims Basically it says if an individual has been the victim of harassment or abuse by any other person, and there is a documented risk, you can get a new number issued. You will need to present: Birth certificate Adoption certificate "Documents showing you have custody" (in other words, birth certificates and adoption decree) Evidence of abuse or threat or abuse or life endangerment To prove the abuse, you "need to provide something from a third party, such as police or medical professionals that describes the nature and extent of harassment, abuse or life endangerment. Other evidence may include court restraining orders and letters from shelters, family members, friends, counselors or others who have knowledge of the domestic violence or abuse. We will help you get any additional evidence needed." I think if the child ever had a broken bone, was left alone, was sexually abused, you had harassing phone calls from birth mom, etc.... you could get this together easily. This is all from a page on the social security office website. I would print it out and take it with me when I go in to request a SS# change so they understand they are supposed to do it under these circumstances.
