Question??
Do the bio parents have to pay child support while child is in custody? As far as, do they have to pay the state or anything?

They are supposed to pay if they are working. My FDs mom is having her wages garnished for support when they were in care 10 years ago. She is only paying a fraction of the cost.

Yes, they have to pay. It depends on how much according to how much they make at a job. If they do not have a job then they still will owe the minimum amount and will stack up unpaid child support.

Here, they are supposed to pay if they can afford it. Usually they can't - or won't, and the state doesn't go after them too hard. I don't personally know of any who have paid. Of course, once TPR takes place they are free of all obligations.

Technically, yes, they have to pay. But I've never seen a bioparent pay, and I've never seen the state make them.

I know the county had biomom of the last placements we had pay for all the things we needed to get for them. Like when I went to get them clothes because they had almost nothing, they asked me to be sure I kept all receipts because she was going to be paying for all their extras while they were here. I have no idea if she actually did but they said she was going to at least.

In VA the parents are supposed to pay for child support to the county but the judge bases the amount on the parent's income and sometimes like with our FS his mom was not made to pay b/c she was supposed to be saving the money for a downpayment on a apartment (housing is VERY expensive in northern VA) - when mom failed to secure and appartment after working her plan for a year - it looked very badly that mom hadn't been paying and still didn't get the apartment. So, I guess it can work against a parent if there is a plan for them to be paying or at least "saving" and they can't do it.

Here in Ga when we went to tpr on our son we were told that bio dad owed like 9,000 for all his kids. he had not paid it in i don't know how long. dfcs told me that even when adoption has happened he still has to continue paying it until it's paid off. that has to stink for them they here they lost their rights, the child has been adopted and they are still paying.

Yes - they should be paying. It can be held against them in a TPR. In Missouri, part of the statute for TPR outlines that the bio should be supporting the child financially in whatever way possible. So if the bios are on disability, then part of the money should go to the state. The courts will also look at if the bios have given anything to the kids with monetary value, including birthday gifts, Christmas gifts & clothing.
I know we have had no gifts or money at this time. I keep a journal of visits, etc. . . so if the time comes where there is a TPR, we will have evidence of what bios did and didn't do. I am rooting for the bios but I also want to protect these kids. Peace. |

My foster son's bmom has gotten him gifts and clothing although I am not sure how due to having no money. I am sure somebody is helping her. I know she owes back support 3 other kids and could be going to jail if she does not pay back by August some time. Somebody in my family asked if she had to pay for C while he was in foster care and I did not think she did, CW has never mentioned it to me. She has no job so i do not see how she could.
Also bdad has done nothing. He has no job either and no home. Supposedly he gets disability and I was told they will not take child support out of his checks so now he wants to see C again when it is convenient for him. He was going to terminate his rights but then he found out he did not have to pay support so he wants to visit with him. He only gets 1 hour monitored visits at agency cuz he is a drug addict. He came to visit and he was high. They did drug test on him and he tested positive for 5 out of 6 illegal drugs. |

I haven't heard anything about it, although that could be because money/housing was part of the problem leading to the kids being put in foster care, and most of our income is going towards getting a nice apartment for when they come home, and having adequate alarms to ensure V doesn't pull another Houdini act.
It doesn't seem fair to take children mostly because the parents weren't making enough money, and then make the parents pay child-support thus extending the amount of time it will take for the parents to earn enough to have everything they need for the kids to come home. |
