Social Security Death Benefits question.

Hello,

My daughter that I recently adopted through OCS has a deceased bio father who she receives SSI from. I am now the payee for her benefits but for the two and a half years she was in foster care (with me), OCS was the payee. For the majority of the time she was in foster care, her monthly board payment was less than what her monthly SSI check is for. Does anyone know what the laws are on this? The social security office tells me that they should have been giving her the full amount each month. It doesn't make sense to me because all foster children get a board payment, so why did she not receive her SSI money on top of that? Or why did they not keep it in a fund to give her once she was adopted?

If anyone has any experience with this, please let me know.

My understanding is that board payment can and should be paid from other sources when those sources are available and SSI is one of those sources (rather than taking my taxes twice). So that much makes sense. However, if her SSI was MORE than her board payment, that money should be SOMEWHERE for her, that is the part of the issue that definitely merits looking into.

I have never been able to get the same answer twice from SSI about this same deal. I can't even find out for sure if the SSI is going to the county towards the reimbursment (which would be fine with me)

Hi, Here in Florida, 4 of my former foster children that I adopted had death benefits from their birth dad. While they were in foster care, the death benefits helped pay for their foster care payments. Because it was divided between 4 kids it did not cover all their foster board rate. The state picked up the remaining cost. After they were adopted the death benefits changed payable to me and the extra money that was left in the accounts all got paid to me by check when they closed the accounts. It is not alot but it helps. I would ask about the account and what happened to the money.

One of our FS receives SSI disability and his SSI payment is more than the board payment. We receive the SSI payment (full amount) instead of the regular board payment. The SSI check goes directly to DHR office, then DHR cuts us a check.

MominAL--Is the son on disability or is the parent? If it is the parent and the money goes to the agency, how do you find out how much it is?

Our fd's mother receives SSI, but I've always assumed it just offset the stipend...

My son is disabled and his SSI check was twice what our board rate was. I questioned that and they said that it covered the administrative costs of having the kid in foster care. It does cost the state more than they are paying me to have a kid in foster care.

I have a little girl that recieves the same benefits and I was told that I could not adopt her so that she could recieve her benefits. If you don't mind me asking how did you go about your situation. I was told that if I adopted her she would not be eligilbe for the SSI anymore. I was in the process of adoption when her mother passed away.
