Unhappy The system fails once again!!!

My 7-month-old foster son who came into care right before Thanksgiving is going back to his abusive parents...he was diagnosed with subdural hematomas with no known medical cause and no one in the family is admitting anything. So the judge in his infinite stupidity told the parents that "he knows that one of them hurt the baby but he is giving him back to them"...totally unbelievable!

I am so disgusted with this system I'm ready to call it quits! I cannot believe that people like him can sleep at night with decisions like this...they had better not hurt that baby again...The caseworkers are shocked over the decision..I'm just sick over it...

I wish I could say I am surprised, but I am not. These kids of situations are the reason we don't foster anymore.

I'm not surprised either,my in-law had a child who's bio mom told them that she didn't want the baby and everytime the baby came from a visit there were bruised on the arms and legs and during the last visit she beat the baby to death. my fd always came from visits with bruises, scratches, cuts, which I reported every after every visit and they still sent the fd home to the bio parent. Don't mean to scare you or anything , but please don't give up fostering because the baby I have now who I've had since she was 3 weeks old and now she's 3 months old. and is just as happy and so beautiful. and lots of fun to have . there's lots and lots of children out there that really really need you . So I wish you lots of luck

How does this make sense on any level? This makes it hard to trust the system to work in the best interest of the child. Poor baby

ugh...It sickens me. My fs came to our home (he was 13 months old) with two swollen shut eyes and his head was swolllen. It took months for the eyes to heal. She still insist that he woke up that way, she has done nothing in her case plan and the Judge granted her unsupervised visits. The only thing is b-mom still does not have a house to start these unsupervised visits so they have not started yet.

Thanks for all your replies!

And to top it off the biomother is pregnant again and due in April. That will be 2 babies under the age of 1 year... If she had stress before and hurt this baby just think what will happen when there are 2 to take care of...

It's just so frustrating and sad

Unless you happen to know a number of lawyers who've become bored with their work, recruiting a candidate for a judicial race could be a challenge.

You might be able to complain to the next court in the pecking order, whatever that is in your state. Even judges have to answer to someone.

Well, come to find out this particular judge was on his way out anyway and doesn't like CPS and so that is probably the reason he ruled that way. What an a******! So an innocent child will have to suffer for his revenge against the System!!!

These judges need to see these children for themselves instead of just the parents so they can put a face to a name on a piece of paper...these are innocent children not docket numbers...

Have you thought about filing a complaing with the the judical board in your state or even the American Bar Assocation?

Now this is just my personal opinion.

It breaks my heart to see that caseworkers, lawyers, and judges dont make the right decisions when it comes to abused and neglected children. Anymore I hear stories of parents who actully do right by their children are the ones that have them put into foster care.

I remember a case in Cambria County(Johnstown, PA) where Children and Youth(CPS in some states) was involved with a mother and her children. The youngest child had a very severe case of diaper rash and eventually it got infected and ended up killing the child. The next to youngest child also had a bad case but it was luckily caught in time. The childrens' grandmother was a daycare supervisor and she failed to report it, and yes she did face child endangerment charges, and all she got was 24 months probation. Now the mother maintained that she didnt do anything wrong but she ended up pleading guilty to child endangerment and involuntary manslaughter. She was incarcerated for 19-56 months and has recently been parolled. CYS didnt have anything happen to them. This is one cases that as they said "fell through the cracks". Am I angry yes I am.

We as a public need to go after these agencies to protect children, and yes we need to also go after our legal system to ensure their welfare.
