What can grandma do?
Hi, we have a foster son, and even though its early in the case it might go TPR. Mom has already lost one child and has drug problem. My question is...The baby has grandparents in another state that might come forward.How much rights do they have ? They have adopted the first child she lost. But they do live in another state, so does she have a good fight,also they are in their 60's...any thoughts?????

They will most likely need to do an interstate compact that takes a while. All relatives get a chance to get the children if they pass the back ground checks just like us. I know a lot of older foster parents so in most cases I don't think that age matters. Good Luck.

The Grandparents stand a very good chance of getting this child. By law age can not be used against them. And the fact that they are raising the sibling shows that they can raise this child.
Because the child is in a different state than the gp means it could take some time to get the homestudy done. If the Judge in your area, court orders the homestudy then it is usually done faster than if the state request the homestudy from the other state. |

We have almost the same thing going on here. We have a little boy since he was four days old, he is now going on eight weeks. Mom had four other children, all went to the Grandmother. She now says that she can't or won't take anymore, but she wants the baby to stay in the family, so there is suppose to be an Aunt that might take him. For seven weeks we have had no contact, but now both Grandmother and mother are getting visits. We are trying to keep the hope alive, but it looks like this little one may not be our forever baby. Though we are a foster to adopt home, we took a chance on this little one. So while we will be devastated at his leaving, we knew from the get go, that he could be ru. Relatives always come first, if found fit. At least in this state.

We had a FS with the exact same situation. Grandparents in another state and they already had his half brother. GParents flew down for a court hearing and took him home with them the next day! They only did background checks, no homestudy. I think fighting this type of situation is an uphill battle.
