Does previous TPR affect this case?
I have been lurking here for awhile and I have a question.
DH and I were licensed on May 2. We got a call for our first placement yesterday afternoon. Wow, we were surpised since we were told that it would be about 6 months. So yesterday at 5 we picked up 3 siblings. Twins (boy & girl) 10 months and a 3 year old boy that will be 4 in August. They are very good children thank goodness going from being married for 12 years with no children to having 3 under 3. My question is this: mom is a single mother. I don't know much other than they had been working with her for while and then found out that she had lost custody of children in another state so they immediately took these. Since she has lost children in another state does that mean anything in this case? Or do they treat this case as a separate deal? Just curious to find out if anyone has run into this. Thanks much. |

Typically, they will treat it as a separate case. Baby J's bparents had tpr on their other 2 children last July, and now we are going through the long, drawn out process for J. It would be great if the courts would take the previous TPRs into account, but I understand that some people change and that everyone has a right to the judicial process and a fair trial. So, each child is a separate case...at least from what I've seen.

In my state, if a parent has had their rights terminated (as opposed to voluntarily surrendered), DCS doesn't have to make any reasonable effort to work with them. Doesn't mean they always stick to that, but they don't HAVE to.

The mom of our eight month old baby girl has five other children. The first three DCS did TPR on her, but the last two she surrendered. They are treating baby E's case as a whole separate case but they also know mom's history and that comes up at meetings. She is still doing the same things that caused her to lose the other five. DCS has told us that baby E will probably go up for adoption. We are just waiting until August to see what is going to happen. Baby E is the daughter I have always dreamed of having, so we are hoping to adopt her.
