appeals
This message was originally posted by Lee.
I just have a question for anyone in NY. Do you know how long a parent has to file an appeal after tpr? And does that time start after the tpr, or after the dispositional hearing? Thanks. |

Lee, I cut and pasted this: Situations could occur as TPR progresses that enhance possibility for semi-accelerated adoption. DSS attomeys, foster care workers and law guardians would have to be the ones to spot these situations. Situations like: ... Parent loses the TPR and 30 days elapse (from actual service) without notice of appeal being filed Margaret A. Thank you Vince. I feel like I know you because I have been a lurker on another board and have been reading this one for awhile before I joined. You always seem to have an answer, and I enjoy your posts. The reason I asked about the appeal is because we had tpr granted on our foster son in July, and the dispositional hearing was in Aug. We have started adoption process and go to court in Oct. for review. Bio-mom called saying she received notice in the mail re: review, and that she will be at court without her lawyer telling the judge she is filing the appeal. From the actual tpr it will be a little over 60 days. I know she probably doesn't have a chance since she walked out of the tpr trial, but I won't be able to relax until the adoption is final. |
