foster care to adopt

Hi,
we have heard from our worker there is a baby in to care right now and the parents might lose there rights so howlong will it take to them to find out to place with a preadoptive family like us. our worker is going to give our homestudy to the child's worker. we are hoping to adopt him she knows we want to adopt.
anyone have any suggestions on how it works, we have been license for a year now, and we just got updated.

Ok I will give you a little of what I know which is not always a lot. I know our study has been out for 2 situations now for a little over a month and our worker said she is going to check on them after Christmas to see what is going on. If TPR has not been finallized it could take longer I know that. Plus at that point there is the appeal process. Don't get your hopes up too high, but also don't let it discourage you. It can take anywhere from a few weeks to months. Good luck to you and keep us posted

Just because a worker thinks the parents rights will be terminated doesn't mean the judge will agree. Depending on the laws where you live, and the reason the child is in care, the judge could order the termination immediately, or give the bio parents anywhere from a few months to a year or more to shape up. And anywhere during that time he could order the child moved into a preadoptive home. Right away so she doesn't have to move again, or waiting until after termination (however long that takes) --both are common.

If termination doesn't happen right away she'll probably go to a "legal risk" home--one that is OK if she goes home and is OK if she stays and gets adopted.

If termination does happen right away, both "legal risk" and "no legal risk" homes probably have the same chances.

If you already knew all this, then I apologize for posting it. But the system is so varied in the things judges tend to do that there is no narrowing it down. Especially since you didn't post if you were a legal risk home or not, or when the baby's first court appearance was to be, or what state you're in. I hope you got some useful info from this, though!

If you are not willing to take 'legal at-risk' kids, you might want to let your worker know you would be willing - if you are. I know it allowed me to get my daughter faster. In her case she was totally free legally, but the state just hadn't done the paperwork to switch her over to the adoption system. So they wanted to put her in an at-risk home immediately, then do the paperwork, so she could be in a permanent situation ASAP. People who did not say they would take 'at risk' were not eligible to get my daughter placed in their home (lucky, lucky, lucky me!!!!).

The downside is that you have to think about the fact that if you do get a true 'legal risk' child, they COULD go back to the birth family. It is more likely that they will not, but the chance is definitely there. So give it some thought.

Good luck!!!! I was considered for 3 different kids before getting my daughter, and while it was disappointing to not be chosen, I have to say that it made it feel like at least things were moving forward. It's an incredible journey.

thanks for the good advice, our worker knows we want to adopt and knows we would take on legal risk the child has only been in care for a couple of weeks they where goign to place him with us but they where having trouble with the family so he went out of county. so she is going to try to give her our homestudy to her again. i know it was a very bad injury to the baby at 6 weeks old, so not for sure if the child will go back to the parent. but i know they have there laws to decide by the judge so what ever happens i will be happy for what they decide on. thansk so much and i wil keep u posted.
