Biomom expecting twins!
I found out yesterday that my fs's biomom is expecting twins in early 09...I'm curious- okay, being nosey- about her chances of being allowed to parent these new babies. My fs is 9 months old and his case was in guardianship when he was only 5 months old- she's lost custody of NUMEROUS other children- but, she's clean now (as far as I know) and seems to be on a good track. I'm hoping that she is able to parents these new babies. Does she have a chance?

From what I know it depends on the state and county. I'm in Wisconsin. birthmom and bd switched counties to get to a more favorable county. My fs (twins) are #9 and 10 for the birthmom and bd. We are waiting for the TPR court date to be scheduled, the paperwork has been filed. Initially the sw was going to send the boys home to the parents. BUT after some research she found out they were being evicted (Feb in Wis - very difficult to evict) and didn't have a home.
In WI, if the previous child was involuntarily tpr within 3 years of the birth of a child the court can TRP immediately. The previous TRP was on appeal and the TRP before that was 3 years and 2 weeks. Couldn't immediately TRP....so we wait. Had the boys parents been working their plan they could have kept these boys. So, if your state works like mine...she has a chance. I will say an extra prayer that she can parent these babies! If not, would you be taking them? My fs have triplet siblings that were 3 in June, they did not want the twins....it was my lucky day! |

I would sincerley hope that if she's been able to maintain sobriety and change her situation that caused the other children to be placed that she'd be given the chance to raise these children.
That being said...I could see some serious risks and concerns being present on the sw's part. Your child is only 4 months away from having been placed in guardianship, so I'm guessing that her sobriety isn't a long term situation. If she is able to parent these new babies, would she then be able to ru with your fs? From reading your post, the mom hasn't been TPR'd yet?

melissa and mom2fabtwins- I too hope that my fs's biomom will be able to parents these new babies; her sobriety is not long, but I know she is working hard at it; she and biodad signed an identified surrender, so, as long as they don't change their minds before the appeal time elapses, they won't be RU'd; I think that, if the babies do come into care, I would be called, but if this happens at birth, I would have to say no because I'm single and, though I would love more kids, twin newborns and a 13 month old would be more than I can handle...I would have DEFINITELY said yes if it was only one baby, though...but, if the removal happens when the babies are older, I may HAVE to say yes!!! That being said, I'm so pulling for these bios to be able to parent these new babies, if its a safe and healthy environment for them.

Irelady, I'm pretty sure that in NJ it's a virtually clean slate for each new child. Details of previous cases can be introduced, but the danger to the child must be established for the latest kids to come into care. What I'm saying is that legally, she should be given the chance to parent, albeit with a case plan, as long as the kids are born clean and can be discharged without obvious danger.

Thinking about this thread, and I remembered that I've heard of more than one case where due to past history, babies were apprehended from the mom in the hospital, every time. I don't know the details, but it seemed to be a 'standing order'.
I'm guessing that her continued sobriety will have the biggest impact...and if the babes are positive at birth, apprehension would be automatic.

Possibly. It all depends on the CW, the judge. My daughter's birth mom was able to take number 12 home from the hospital although she had 3 open cases at the time. This was because the CW was hoping birth mom would really get it together with this new baby. The last three of birth mom's kids are 13 months apart. When the judge found out what DCF allow happen, he or she ordered the child be taken. Of course, they now can not find birth mom.
So like with all things with the system, you just never know. |

My FD's mother had a baby back in June and we were on the road to TPR - we had our first TPR trial on June 4th and she had the baby on June 5th - my FD is now our daughter and her parents lost their parental rights but they still have her little sister until they mess up. Sometimes it is hard to understand why but with this I feel like they are really trying and they should have a shot.
