TPR is almost here and a ?
Our TPR trial is almost here--first week of November!
After that, I know they have a permanency hearing scheduled in December. We are the concurrent family for these children. Will we be able to petition for adoption once the TPR hearing is over or do we have to wait until that perm. hearing? It sounds to me like we can file right away. Also, when are other parties clearly out of the picture. I should not worry--and I don't most of the time but as it gets closer you get this feeling that something will drop from the sky! ![]()

Not to totally freak you out, but our kids were legally freed (bmom relinquished at the TPR trial) in April. They told me last month it may be another YEAR before we finalize.

My little guy was legally free in June. Adoption should be finalized by February.
It all depends on the cw, the paperwork and the courts.

The permanency hearing is likely irrelevant to your dates.
Not to rain on your parade . . . How firm is the TPR trial date? (ours was continued five times for various reasons) Do they think that it will actually go to trial or are bparents thinking about voluntarily relinquishing (maybe in exchange for an open adoption?) Do they think that the trial will be completed in one day? (Courts often schedule more than one trial in a day - it can take a good part of the day just to figure out which one is going to start and then there may be procedural motions the Court needs to consider before starting the actual trial) If not - have they already scheduled the second trial date? Getting day two scheduled can take weeks, at least. I am in the middle of a trial that started in September - day two was continued because someone was sick - day three is scheduled for November and day four in December. Once the trial is over, there couldwill likely be a wait while the Court writes a decision. Then the bio parents will have time to appeal. This is not a quick process. But - once it is over, and the appeal time is done, you can usually petition to adopt right away. Our son's bmom relinquished in July '07 and we finalized in November. Good luck. They started off saying this could go as quick as 30 days. I'm hoping they'll revert back to that. But I'm not worried if it takes longer. It'll happen ![]()
