Post Tpr hearing......
Hi my husband and I attended our FS parents hearing today and the rights got terminated! We are his foster to adopt parents but my question is what happens next in the process? We have a post TPR hearing in September what happens at those? I am excited about the rights being terminated but still worried if anything could pop up and my lil angel could leave? I will briefly tell my story no relatives have came forward his whole little 6 months of life. And mom has been a neglectful parent who lost custody of her other 5 children and she also does drugs and so does dad. Now being that no relatives have come forward at all will we be the first to be chosen for adoption now that the rights are terminated? Thanks everyone in advance

The post-TPR hearings are just periodic checks that the process is moving forward if the adoption has not yet happened. In San Diego, they have them every six months. We TPRd last October and the bd appealed so we waited another six and a half months for that to run its course. Now we wait for the remittitur which is a 60 day wait.
Our kids had a post-TPR hearing in April so the judge could be kept up-to-date that the process was moving forward. No big deal. If there is no appeal in your case, the follow up court hearing might not be necessary if you can finalize in the next six months. I would say that when your son was placed with you it was with the intent that you would move to adoption if a reunification did not happen. So I think you've already been "chosen." Good luck. There may be an appeal because the attorneys like to cover the bases for for their clients, even if they are losers. But the TPR is the biggest hurdle so congrats and give your boy a big hug from all of us. |

In our state the foster parents have to be designated as 'current caretakers', and then after TPR and if they want to adopt, they still have to be 'matched' or go through the process of having DHS designate them as the 'adoptive placement'. I think most states have something similar; there may be other terms used, it may be more streamlined (or less), but there usually is some paperwork that has to be completed by the cw's and their supervisors, etc.
Contact your worker and find out what the next step is, being sure that they know that you wish to adopt if this child becomes available for adoption. Sounds like a no brainer, but there are cases where the communication between foster parents and cw's was really garbled, so try to get clear statements and explanations for anything you don't understand completely. In our case, with a relative who was in foster care, when the worker decided to request TPR they also requested that our family be named as the adoptive placement, and that the judge grant that the child could move out of state prior to TPR. As it turned out the TPR was uncontested by the bio parents and the child was placed with us a couple of months prior to the TPR trial date. In our case the adoption was final 7 months after the child was placed with us. (Yes, that was very quick, but ALL the ducks were in a row, so it went fast.) Oh, and after the TPR is ordered by the court there is an appeal period. This is different lengths of time in different states. Usually around 30 days or so. If no appeal is filed then the TPR stands. Nothing goes forward until the appeal period is over. The paperwork and the plans may all be in place, but nothing can officially be done until the appeal period is past.

We only had to wait a couple of months after bd was TPR'd for finaliztion.

For ours where bparents did not appeal we were adble o adop in a maer of 2 1/2 months now wih our guy where bdad appealled i ook us a total of 10 months from TPR hrough appeal to adoption

Yes here it is a 21 day time frame for an appeal. And we are supposed to be down as the chosen adoptive placement. Because they moved him from his previous foster home once we were chosen as his fost to adopt parents.

The TPR trial for my foster daughters birth parents was June 8th and we are in the middle of the 30 day appeal period. We attended a Permancy Hearing yesterday where the judge told us that things are moving slowly in our county, we may not be able to adopt for 6 weeks or so if there is no appeal. We were thrilled with that time period but this judge is so pro adoption he gets annoyed at our slow moving system. We go back on July 16th for an Adoption Status meeting, then we should know if an appeal has been filed.

Wonderful and congratulations!!!!Yes that is a short time frame I hope ours goes that quickly.How old is your FD?
