TPR hearing rescheduled

Our TPR hearing was yesterday. I was not impressed with the way things happened at all! CW said it was a "sure thing" because all parties were in a agreement. So, here is what happened.

Baby N's birth certificate lists the father as unknown. Throughout the case, she has had an "alleged father" so they were just going to terminate rights on the "alleged father." Well, in court yesterday, they decided that they can't terminate rights on him, because the birth certificate says unknown. HELLO PEOPLE! The birth certificate has said that for the last 6 months! So, with five freakin court appointed attorneys and three case workers, they didn't figure this out until the day of court???? WTF???

I'm very irritated. This case was originally a voluntary relinquishment, but they wouldn't take biomom's relinquishment because she is mentally ill. And now we are postponing TPR until September 7. If it is granted, 60 day appeal will be over November 7, and everyone will probably take a vacation until after the holidays! She's going to be 18 months old before all of this is said and done!

CW's and county attorney say not to worry, "Baby N is safe with you." Yes, but I would like her not to be Baby N anymore, and I would like to know she will always be safe with me!

I know alot of you have been through this so thanks for letting me vent!

I feel for you!

Our little A's birth certificate names a man that I swear the bioM got the name from the tv show the Soprano's! They have never been able to locate or verify that this man ever really existed.

So, we went through a first a publication on BD with no response. But the court wasn't satisfied with that, so they then had to do a John Doe publication because of they couldn't verify that the named BD was a real person. We had to wait twice! They could have simultaneously done the publications!

Our little A was finally TPR'd last January. We still don't have a finalization date set because AZ's adoption unit is short staffed. Nice...

Birth mom to R (11) who was born preemie with a heart defect that was repaired by open-heart surgery, who is now utterly amazing!
Placement 02/25/05: Beautiful girl A abandoned at birth, now 4 years old and into EVERYTHING! (especially our hearts!) TPR 01/18/06. FINALLY assigned an adoption worker after 8 months with zero activity!!! We finalized 12/06/06!!!! Little A is FINALLY ours!

Steph - I am so sorry - I understand completely the pain and frustration and FEAR you must feel. It WILL work out. We had to "publish" the notice of intent to TPR in order to meet due diligence in finding our son's BF which I am sure is what they will do for your daughter. The publishing happens in the most obscure newspaper you have NEVER heard of. I googled the newspaper and called the circulation office and never was able to find it. Trust me - it is 4 weeks of hell but it won't matter. We will think of you and say a lot of prayers. Tiffany

So, let me get this straight...they publish something in the local paper saying did anyone sleep with this woman and possibly father a child? LOL that sounds ridiculous. Bio parents were locked in a mental institution at the time of conception...not likely that they will be reading the paper!

I swear, this is an attempt by God to teach me patience because I have none!

Your situation is certainly nothing like mine, yet I identify with the frustration and the incredible length of time it takes to get anything done! Our social worker confided in me the other day that she thinks the WORST flaw in the system is that the courts bend so far over backwards to protect the rights of the PARENTS that they lose sight of the children. In our case, the TPR has been adjourned 3 times (from January until now the end of August) because the bio mom has REPEATEDLY refused to talk to her lawyer - keeps sayind she doesn't have time, because she is working. Of couse, I wonder how she'd have time to raise kids, then? Really, I wonder at what point the court says "Gee, I'm sorry to hear that - but we're going ahead as scheduled.". I don't even have any faith that it'll actually go through in August now - what would keep them from just postponing it again?
